Chief Psychiatrist’s guideline on Conducting an examination under the Mental Health and Wellbeing Act 2022 - effective 1 September 2023.

The Mental Health and Wellbeing Act 2022 contains mental health and wellbeing principles that include promoting and protecting the dignity and autonomy of people living with mental illness or psychological distress.

Mental health and wellbeing service providers must make all reasonable efforts to comply with the mental health and wellbeing principles when exercising a function under the Act (s 29(a)) and must give proper consideration to the principles when making a decision under the Act (s 29(b)).

This Chief Psychiatrist’s guideline outlines what is an examination, and how should an examination be conducted under the Mental Health and Wellbeing Act 2022.
