Sale or supply of poisons or controlled substances by wholesale

Under Sections 23 to 27 of the Drugs, Poisons and Controlled Substances Act 1981, there are limitations on licence holders with respect to the supply of poisons and controlled substances.

In general, holders of a licence to manufacture and sell or supply by wholesale poisons or controlled substances or a licence to sell or supply by wholesale poisons or controlled substances are required to ensure that, except for a Schedule 5 poison, a Schedule 6 poison or a Schedule 7 poison that is not a Schedule 7 poison that is included in the Poisons Code in the list of substances that are not for general sale by retail, sale or supply is made only to authorised persons or to those persons holding an appropriate poisons licence/permit.

The list of licence/permit holders is included in PDF format and is current on the date indicated by the file name and on each page of the report.

Licence holders should review the list carefully to ensure that the person to be supplied holds a relevant licence or permit.

In particular, you should check the expiry date and the columns numbered 1 to 9, which indicate the schedule number to which the licence/permit relates.

  • "A" in the column indicates that the licence/permit relates to all substances in that schedule.
  • "L" in the column indicates that the licence/permit is limited with respect to the substances in that schedule that are permitted to be obtained and/or supplied. Where the list shows that a licence/permit relates only to limited substances within a schedule, a copy of the licence/permit may need to be sighted prior to supply.
  • Where the column is blank, it is an indication that the licence/permit is not approved with respect to this schedule at all.

Note that the person(s) named on the poisons licence/permit should understand the relevant provisions of the Drugs, Poisons and Controlled Act 1981 and Regulations.
