Under section 19 of the Drugs, Poisons and Controlled Substances Act 1981 a licence or permit may only be issued to a fit and proper person.

Requirements

Applicants for a licence or permit must provide the name(s) of the proprietor(s) / director(s) of the organisation. If the organisation is registered as a company, with an Australian Company Number (ACN), then the name(s) of director(s) should be provided. Otherwise, the name(s) of proprietor(s) should be provided.

The proprietor(s)/ director(s) of an organisation must submit a copy of a national police check issued within the previous 6 months if they are applying for:

  • A manufacturing and wholesale licence; or
  • a wholesale licence listing the schedule 8 or 9 poisons

During the application assessment process, the department may request extra evidence for the purposes of fit and proper person assessment. Extra evidence may include:

  • a copy of licences, permits or other authorisation from other relevant agencies. These agencies can include the Therapeutic Goods Administration, Commonwealth Office of Drug Control, Ahpra or another State or Territory department
  • details of a refusal or rejection of a licence, permit or other authorisation from a relevant agency
  • details of a cancellation or suspension of a licence, permit or other authorisation from a relevant agency
  • =a copy of an outcome from a relevant accreditation body
  • further information relating to offences relevant to the organisation or proprietor(s) / director(s) of the organisation

Further information

The department may seek further information in relation to the nature of the organisation or operations of the organisation. This information may include:

  • a description of the business model
  • intended customers of the organisation, such as names of authorised costumers of business intended to be supplied under a licence
  • location of the staff
  • a rationale for why an application is being made for a Victorian licence or permit, in the case of interstate-based organisations
