Mental Health Regulations 2008Mental Health Regulations 2008 (External site) The Mental Health Regulations define terms and prescribe forms, fees and statements of patients' rights for the purpose of giving effect to the Mental Health Act1986. The Mental Health Regulations commenced on 21 September 2008 and replaced the Mental Health Regulations 1998. The 1998 Mental Health Regulations were replaced because of a requirement in the Subordinate Legislation Act 1994 that all regulations be automatically revoked 10 years after they are made. The new regulations are substantially the same as the previous regulations. The key changes are that the statements of patients' rights now include information about the Charter of Human Rights and Responsibilities Act 2006 and a new procedure has been established to elect members to the Community (Psychiatric Services) Visitors Board.
